GUIDELINES IN PLACE TO ENSURE PROPER EXPECTATIONS & UNDERSTANDING
By ordering services from District Imagery, the client agrees to the following Service Agreement for video and photo needs. We have these guidelines in place to ensure a smooth and efficient service is completed by us as District Imagery and received by you as the client.
APPOINTMENT REQUESTS:
To ensure the best results of the appointment, please be sure the property is ready prior to the scheduled appointment.
By confirming your appointment, you agree to the readiness expectations and policy: you agree that the home will be ready to photograph and film on the scheduled date and time you have selected. This includes working with the builder and seller to ensure the home is photo and/or video ready prior to our arrival.
While District Imagery does strive to honor the requested appointment time, we do reserve the right to change your time to accommodate our travel schedules.
Any home that is not photo and/or video ready on the scheduled date and time will result in a $75 day of rescheduling and/or day of cancellation fee.
For liability purposes, District Imagery does not handle any of the prep for the readiness of the property, including but not limited to, cleaning or moving of furniture.
TIME, CANCELLATIONS, AND WEATHER POLICY:
By confirming your appointment, you agree to District Imagery’s cancellation/reschedule policy: cancellation/reschedule of appointment is allowed up to 24 hours before appointment.
Any cancellation and/or rescheduling of appointment within 24 hours of the scheduled appointment will result in a $100 fee.
Though we do not charge for a rescheduling fee due to weather related circumstances, it is at the client’s discretion if they would prefer to reschedule the set appointment due to weather related circumstances. NOTE: We cannot provide aerial/drone services while it is raining/there is moisture in the air or during hazardous wind conditions.
If the client would like to reschedule due to weather related conditions, we ask the client to reschedule within 24 hours before the appointment.
Turnaround time for video is typically 1-5 business days.
Turnaround time for photos is next-day delivery by end of the business day.
Next-day video rush delivery is available at a fee of $200. However, District Imagery may not always be able to provide this service.
REFUNDS:
At District Imagery, our services are nonrefundable. We pride ourselves on producing the best media possible at all levels. If you are unhappy with your media, please contact our office directly at 918.766.3234
TRAVEL & ADDITIONAL SQUARE FOOTAGE COST:
District Imagery covers a 25 mile radius within our central office location at 6714 N 128th E Ave, Owasso, OK 74055. In the case District Imagery is needed to travel 25 miles outside of our central office location, there will be an additional travel fee for any miles traveled outside of our 25 mile radius from our home office (this includes travel to and from the location). This fee covers District Imagery’s time and operational cost. See our online booking platform to visit the calculator to determine your travel cost based on your property location. All mileage outside of the state of Oklahoma does require a custom travel quote.
VIDEO POST-EDITING:
District Imagery’s photos are delivered next-day by end of the business day. Any additional photo edits, photoshop, clean up, specific/intricate requests, etc. will require a $10 per photo re-editing charge. Please include all intricate details regarding editing requests in the appointment notes at booking to avoid any re-editing fees.
District Imagery’s video walk-throughs typically follow a format of drone footage followed by property walk-through, with royalty free music. If another format is needed, the client must provide specific requirements or details in the “comments” section when booking an appointment with District Imagery prior to editing.
Any additional edits to a video or photo order after District Imagery has finalized it requires additional work for District Imagery and will be subject to a re-editing fee of $100 minimum. This re-edit fee could be greater depending on the client's edit requests.
LIMITED LICENSING RELEASE:
District Imagery does not sell photographs or video. Instead, we license the use of them for the sell and promotion of a real estate listing or commercial/ event promotion. Photographs and videos are considered intellectual property– much like music or software you may purchase. You’re not ‘owning’ the photos/music/software, but instead using it for your specific need, which in most cases is the sell and promotion of a listing or event. In any case, the photographs and videos should only be used for what the client indicated during the initial agreement.
In the Licensing Release, only the client has permission to use the delivered photos and video on any electronic or printed forms of advertisement for the promotion of the listing. Clients may use these videos and photographs on their social media or MLS listing services by the purchasing client, solely for the promotion of the listing during the pendency of the agreement. This means that any builders, stagers, designers, or “third parties” who wish to use photographs or video owned by District Imagery must contact us directly for licensing and fees of their own.
However, regardless of any terms and conditions of the MLS, at no time does this agreement provide the right to transfer copyright or any other exclusive rights as provided by the Copyright Act 17 U.S.C § 106.
Media Integrity & Modifications: All photographs and videos delivered by District Imagery must retain their original visual integrity. Except for permitted resizing, cropping, minor technical adjustments, and standard platform formatting, clients may not modify, manipulate, digitally enhance, or create derivative works from delivered media without prior written authorization from District Imagery. This includes modifications performed through artificial intelligence, traditional editing software, or third-party services. All modifications are subject to the Artificial Intelligence (AI) Use & Digital Media Modifications policy outlined in this agreement.
Photographs and video can be made available to another real estate agent or person who takes over an expired or withdrawn listing at a rebranding fee. Please contact us for any rebranding needs.
The key words are permission and license. Without it, you’re in violation of our terms of service, but more so, you’re discrediting our originality. If you’re unclear on the usages of your photos or videos, be sure to ask any and all questions. We're here to be a team and want nothing but transparency with our clients!
PAYMENT & LATE FEES:
Full payment is due upon delivery of media at time of download. We do require payment for media to be unlocked in the property gallery to allow for download.
Overdue payments are subject to a $50/week late fee at our discretion.
Payments overdue past a month are subject to an additional $200/month or 10%/month late fee at our discretion.
Booking a service with us means you agree and understand the payment schedule on your quote/order and the applicable late fees for non-payment.
In the event the bill goes without payment for more than 4 weeks, GTAR and your brokerage office will be contacted and informed of the outstanding balance to a vendor.
PHOTO & VIDEO USAGE:
Video and photos produced by District Imagery may be uploaded to any social media or MLS listing services by the client, solely for the promotion of the listing during the pendency of this agreement.
However, regardless of any terms and conditions of the MLS, at no time does this agreement provide the right to transfer copyright or any other exclusive rights as provided by the Copyright Act 17 U.S.C § 106.
Usage Rights for Property Promotion: Clients who pay for our services are granted a non-exclusive, limited license to use the content on any web platform or in printed materials for the promotion of the specific property while it is listed with them. This license expires once the property is no longer listed with the client.
Usage Rights for Personal and Business Promotion: Clients are granted perpetual permission to use the final, edited photographs and completed videos delivered as part of their purchased services for personal and business promotion, including websites, social media, printed marketing materials, and other promotional uses. This license does not extend to raw footage, unedited photographs, unused video clips, or other media not included in the final deliverables. All usage remains subject to the licensing restrictions outlined in this agreement.
District Imagery reserves the right to use all created content for promotional purposes, including on our website, social media, and marketing materials.
RAW FOOTAGE, UNEDITED PHOTOS & INDIVIDUAL CLIPS:
Ownership: All raw photographs, unedited video footage, individual video clips, unused footage, and other original media captured or created by District Imagery remain the exclusive intellectual property of District Imagery.
Standard Deliverables: Unless otherwise specified in writing, the purchase of photography or videography services includes only the final, edited media delivered to the client. Raw photographs, unedited video footage, individual clips, and unused footage are not included in standard packages or deliverables.
Licensing & Usage: Usage rights granted to the client apply only to the final, delivered media and do not extend to raw footage, unedited photographs, unused clips, or other media not specifically included in the purchased deliverables. Permission to use completed videos or photographs for ongoing personal or business promotion does not grant the client access to the original files or the right to request additional footage from previous projects.
Additional Footage Requests: Request for raw photographs, individual video clips, unused footage, or previously undelivered media are considered separate from the original service agreement. District Imagery reserves the right to approve or decline these requests at its sole discretion. If approved, additional editing, retrieval, delivery, and licensing fees may apply.
Modifications & Redistribution: Unless expressly authorized in writing, clients may not distribute, sell, sublicense, or provide raw footage or individual clips to third parties, nor may they independently re-edit, repurpose, or modify such footage for new content.
Footage Retention: District Imagery does not guarantee long-term storage, retention, or availability of raw photographs, original video files, or unused footage after final media has been delivered. Any subsequent request are subject to file availability.
ARTIFICIAL INTELLIGENCE (AI) USE & DIGITAL MEDIA MODIFICATIONS:
Restrictions on AI-Generated Content: All photographs and videos created by District Imagery are protected intellectual property. Clients are granted a limited license to use the final, delivered media as outlined in this agreement. This license does not include permission to use District Imagery's photographs or videos as source material for artificial intelligence (AI) tools, generative editing platforms, or other automated services to create new or modified visual media without prior written authorization.
Prohibited Modifications: Without prior written authorization from District Imagery, clients may not use AI-powered tools, third-party applications, or other editing software to alter, transform, or generate derivative media from photographs or videos produced by District Imagery. Prohibited uses include, but are not limited to:
o Converting daytime photographs into virtual twilight or nighttime images.
o Virtually staging, furnishing, decorating, or removing furniture from photographs.
o Converting still photographs into animated videos, walkthroughs, or other motion-based content.
o Using photographs or videos to generate AI-enhanced, AI-modified, or entirely new visual content.
o Using AI to add, remove, replace, or substantially alter architectural features, landscaping, skies, furnishings, or other property elements.
o Submitting photographs or videos to AI image-generation or video-generation platforms for the purpose of creating modified or derivative content.
Third-Party Services: These restrictions apply whether modifications are performed directly by the client or by a third party acting on the client's behalf, including marketing agencies, virtual staging providers, social media managers, or other media production services.
Permitted Uses: Clients may resize, crop, or make minor technical adjustments necessary for proper display on websites, MLS platforms, and social media, provided such adjustments do not materially alter the original appearance, composition, or representation of the property. Standard platform-generated formatting and compression are permitted.
Additional Media Services: Virtual staging, virtual twilight photography, photo-to-video conversion, and other specialized editing services are available directly through District Imagery. Clients wishing to obtain these services using District Imagery's photographs or videos must request them through District Imagery or obtain prior written authorization.
Unauthorized Use: Any modification, transformation, or creation of derivative media outside the permissions granted in this agreement constitutes unauthorized use of District Imagery's intellectual property and may result in termination of the applicable license and pursuit of available legal remedies.
WORK PRODUCT OWNERSHIP:
Any copyrightable works, ideas, discoveries, inventions, patents, products, or other information (collectively, the “Work Product”) developed in whole or in part by District Imagery shall be the exclusive property of District Imagery.
District Imagery reserves the right to use video and photos for advertising, display, publication, or other purposes.
All photographs, videos, raw footage, individual video clips, unedited files, project files, samples, and proofs remain the exclusive intellectual property of District Imagery unless waived by amendment to this agreement. Unauthorized use of photographs/video is a copyright violation and will result in the termination of this contract.
PROPERTY OWNER APPROVAL:
The Client may need to obtain a written signed approval from the property owner prior to filming or taking pictures. District Imagery can provide (at request) a written approval form.
District Imagery makes every effort to maintain the privacy of the property owner's neighbors. All footage is focused on the property being filmed and District Imagery will do best to respect the privacy of anyone not directly involved. If necessary, the client may be required to ask for permission from neighbors before District Imagery begins filming.
SEVERABILITY:
If one or more of the provisions contained in the Agreement is found to be invalid, illegal or unenforceable in any respect, the validity, legality, and enforceability of the remaining provisions shall not be affected. Such provisions shall be revised only to the extent necessary to make them enforceable.
